These terms apply to the brand and influencer collaboration feature and form part of the Hirencer Terms and Conditions.
1. Purpose
The collaboration feature was built to reduce payment and trust problems between a brand and an influencer who have already agreed to work together. It lets them write down the deal, set payment milestones, submit content links, track status and route payment through a Payment Provider so each side can see what has been paid.
2. What QuinPin does and does not do
- We do not hold money. No collaboration money is held in any QuinPin bank account. The brand’s payment goes to a Payment Provider (such as Razorpay or Stripe), which holds, releases and refunds it under its own licences and terms. We request actions from the provider and record what the provider confirms.
- We are not an escrow agent, bank or payment institution and do not guarantee that any amount will be available, released or refunded. Release is subject to the provider’s rules, timing, KYC and availability.
- We do not verify brands, influencers, identities, followers, audience, engagement, ownership of social accounts, or content. Automated and manual checks (such as checking that a link opens, the caption, hashtags, mentions and time online) are aids only and are not legal, quality, authenticity or compliance reviews. Anything unclear may go to manual review.
- We are not a party to the collaboration agreement between the brand and the influencer, and we are not an agent of either of them.
- We never treat a timer alone as proof of delivery. A milestone is released only when its stated conditions are met and the Payment Provider confirms.
3. Brand responsibilities
- Describe the deliverables, deadline, content requirements and payment milestones accurately. Percentages must total 100%.
- Pay the agreed amount plus the platform fee through the Payment Provider.
- Have the right to use any brand assets, products, claims and trademarks you ask the influencer to use, and make sure your claims are lawful.
- Comply with advertising and endorsement laws in every relevant country.
4. Influencer responsibilities
- Complete your profile and accept the Terms and Privacy Policy before accepting a collaboration. Give accurate information about yourself and your accounts.
- Deliver the content as agreed, publish only content you have the right to publish, and keep it online for any agreed minimum time.
- Disclose paid partnerships clearly as the law and platform rules in your audience’s countries require (for example ASCI guidelines in India, FTC rules in the United States, CMA/ASA rules in the United Kingdom, and similar rules elsewhere).
- Complete the Payment Provider’s identity and payout set-up to receive payouts.
5. Verification and disputes
- Status shown on Hirencer has separate parts: the collaboration status, content verification status and payment status. Payment status comes from the Payment Provider.
- Either side can open a dispute. While a dispute is open we may mark unreleased milestones as on hold on Hirencer and ask the Payment Provider to keep them on hold, where the provider supports that.
- Our staff may record an administrative decision on a dispute. That is not a legal decision, does not bind courts or the Payment Provider, and does not replace the agreement between the parties. The Payment Provider’s own rules decide what it can release or refund.
- Parties remain free to resolve disputes between themselves, by mediation, arbitration or in court.
6. Intellectual property and usage rights
Ownership and usage rights of the content (for example whether the brand may re-use or boost the influencer’s post, for how long and where) are for the brand and the influencer to agree. If they do not agree otherwise, the influencer keeps ownership of their content and grants the brand only the right to share the published post. Hirencer takes no rights in the content except as set out in the Terms.
7. Cancellations and refunds
Cancellation rights, deadlines and refund of the collaboration payment are governed by the agreement between the brand and the influencer and by the Payment Provider’s rules. The platform fee follows our Return and Refund Policy.
8. Global use and legality
Brands and influencers may be located in any country. We do not verify that a collaboration or payment is lawful in a particular country. You are responsible for checking whether this feature is permitted where you live and for complying with local rules on advertising, payments, foreign exchange, taxation (including withholding), sanctions and anti-money-laundering. The feature may be unavailable or limited in some countries and may be switched off or changed at any time.
9. Taxes
The brand and influencer are each responsible for their own taxes, invoices, GST/VAT, withholding and reporting. Nothing here is tax or legal advice.
10. Limitation
To the fullest extent permitted by law, QuinPin is not liable for non-payment, late payment, non-delivery, poor quality, losses from any collaboration, Payment Provider delays, holds or failures, or any act or omission of a brand or influencer. Our liability is limited as set out in the Terms and Conditions.
